Terms and Conditions for Clark Community Network

1) ACCEPTANCE AND ACKNOWLEDGMENT OF TERMS and conditions

WesPAC (Clark Community Network) (“Clark Community Network”) provides the following service to you, subject to these terms and conditions (“Terms”). Clark Community Network reserves the right to periodically update, alter, add, remove, or otherwise change the Terms. By completing the registration process, you are agreeing to and acknowledging the Terms set forth herein. Failure to comply with the Terms may lead to immediate revocation of a user account.

2) DESCRIPTION OF CLARK COMMUNITY NETWORK

You acknowledge that Clark Community Network is a web-based service that allows users to establish accounts through which the users can create and post online formatted text stories, post comments about other users’ stories, rank other users’ posts, and post links to other web sites.

3) USER INFORMATION

You agree and acknowledge that registration is required in order for a user to create an account and utilize Clark Community Network. You agree to provide accurate, complete and current information about yourself in all required fields. Users are required to update any information submitted to Clark Community Network, if a change occurs. Clark Community Network reserves the right to suspend and/or terminate a user account if Clark Community Network suspects that the submitted information is incomplete or inaccurate.

4) PRIVACY POLICY

The Clark Community Network never shares mailing lists with non-Democratic third parties or entities unaffiliated with Wesley K. Clark. If you have questions or concerns regarding this policy, please mail the address below.

5) USER ACCOUNTS

You acknowledge that Clark Community Network currently utilizes a three-tier account structure which are available in accordance with local law, including the Children’s Online Protection Privacy Act (COPPA) which restricts children under the age of 13 from registering:

* Anonymous: Clark Community Network does not allow non-registered users to submit responses to posts anonymously.

* User Accounts: These accounts have access to all the account features for the duration of the site. Users are responsible for regulating the content of user comments submitted to their blog.

* Section Editor Accounts: These accounts are generally granted to people associated with particular groups (e.g. Wisconsin for Clark, Environmentalists for Clark, etc.). Section editors must apply and be selected before access is granted. Section editors are responsible for regulating the content of user comments submitted to the blog associated with their section.

6) SERVICE LIMITATIONS, MODIFICATIONS, AND TERMINATION

You agree and acknowledge that Clark Community Network reserves the right to, temporarily or permanently, modify, or limit the Service with or without notice. Clark Community Network shall not be liable to you or to any third party for any modification, suspension or discontinuation of the Service. Clark Community Network may in its sole discretion, discontinue providing the Service, or any part thereof.

You agree and acknowledge that Clark Community Network, in its sole discretion, may terminate your user account, and remove and discard any content within the Service, for any reason, including and without limitation, the lack of use. Any contracts, verbal or written or assumed, in conjunction with your deleted blog and all its parts, at Clark Community Network’s discretion, will be terminated as well. You agree that any termination of your access to the Service under any provision of this Terms may be effected without prior notice, and acknowledge and agree that Clark Community Network may immediately deactivate or delete your Clark Community Network blog and all related information and files. Clark Community Network reserves the right to bar any further access to such files or the Service. You agree that Clark Community Network shall not be liable to you or any third-party for any termination of your access to the Service.

7) INFORMATION ON CLARK COMMUNITY NETWORK

You agree and acknowledge that you are only permitted to use the Service as authorized and you acknowledge and agree that the Service may contain proprietary and confidential information that is protected by applicable laws governing intellectual property, proprietary rights and the like. You acknowledge that all code and specifications are subject to the respective said or implied licenses.

8) PROHIBITION ON RESALE AND DUPLICATION

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion, use or access to the Service without the express consent of WesPAC.

9) INDEMNITY

You agree to indemnify and hold Clark Community Network, and its subsidiaries, affiliates, officers, agents, partners, and employees, harmless from all claims, liabilities, demands, costs, including reasonable attorney fees, made by any third party due to or arising out of your use of or connection to the Service, your violation of the Terms, or your violation of any rights of another, whether you are a registered user or not. You acknowledge that you, as a user, are solely responsible for using the Service.

10) LOCAL, DOMESTIC, AND INTERNATIONAL USE

You agree to comply with all local rules and state and federal laws regarding online conduct and acceptable content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or your country of residence.

11) FUNDRAISERS

You agree and acknowledge that WesPAC reserves the right to conduct fundraisers on the Clark Community Network. You agree and acknowledge that Clark Community Network has the right to run such fundraisers with or without prior notice, and without recompense to you and that Clark Community Network shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such fundraising on the Service.

12) EXTERNAL SITES AND LINKS

You agree and acknowledge that the Service, or relevant third parties, may provide links to other web sites. Because Clark Community Network has no control over such sites, you acknowledge and agree that Clark Community Network is not responsible for the availability of such external sites, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites. You agree and acknowledge that Clark Community Network shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.

13) GUIDELINES FOR BLOG CONTENT

You agree and acknowledge that you are responsible for all content you post to Clark Community Network. Clark Community Network is under no obligation to restrict or monitor blog content in any way and acknowledge that that Clark Community Network does not pre-screen content.

You agree and acknowledge that Clark Community Network is committed to keeping the Service in decent standing for all audiences but is not responsible for the monitoring or filtering of any blog content. Should any content be deemed illegal by such law having jurisdiction over the user, Clark Community Network is committed to submitting all necessary information to the proper authorities.

You agree and acknowledge that Clark Community Network and its designates shall have the right (but not the obligation) in their sole discretion to refuse or remove any Content that is available through the Service. Clark Community Network and its designates shall have the right to remove any content that violates the Terms or is otherwise objectionable. If any content be reported to Clark Community Network as being offensive or inappropriate, Clark Community Network might call upon the author to retract, modify or remove the Content in question within a reasonable amount of time, as set forth by the Clark Community Network staff and if the author fails to meet such a request from Clark Community Network staff, Clark Community Network has the full authority to terminate any account holding such inappropriate content.

You agree and acknowledge that you must evaluate, and bear all risks associated with, the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content. Clark Community Network reserves the right to limit access to your blog, if found in violation of the Terms, by removing the blog and related user information from the user database, search engine, and all other methods used in conjunction with finding Clark Community Network’s users.

You agree and acknowledge that, within the confines of international and local law, Clark Community Network will not place a limit on the type, or appropriateness of user content within blogs. Those users posting material not suitable for all audiences must agree that they are fully responsible for all the content they have posted anywhere on the service and allow Clark Community Network to delete any content deemed inappropriate, offensive, libelous, or slanderous.

You agree and acknowledge that Clark Community Network claims no ownership or control over any content posted by its users. The user retains all patent, trademark, and copyright to all content posted within available fields, and is responsible for protecting those rights, but is not entitled to the help of the Clark Community Network staff in protecting such content.

14) USER CONDUCT

You agree and acknowledge that you are solely responsible for all content that you post or otherwise transmit. Clark Community Network does not control nor gaurantees the validity of an content posted via the Service. By using the Service, you acknowledge that you may be exposed to content that you find offensive, indecent or objectionable. Without limitation, if content is found or reported to be in violation of the following terms, it will be Clark Community Network’s sole discretion as to what action should be taken.

15) PROHIBITED CONDUCT

You, as a user, agree to NOT use the Service to upload, post or otherwise transmit content that:

a. is in Clark Community Network’s opinion is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive to another’s privacy (up to, but not excluding any address, email, phone number, or any other contact information with out the written consent of the owner of such information), hateful, or racially, ethnically or otherwise objectionable;

b. you do not have a right to transmit under any law or under contractual or fiduciary relationships;

c. infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;

d. is unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation;

e. contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

You, as a user, agree to NOT use the Service to harm minors in any way, as determined by Clark Community Network or applicable law.

You, as a user, agree to NOT impersonate any person or entity, including, but not limited to, a Clark Community Network staff member or volunteer, or falsely state or otherwise misrepresent your affiliation with a person or entity or forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the Service.

You, as a user, agree to NOT use the Service to interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service.

You, as a user, agree to NOT use the Service to intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law.

You, as a user, agree to NOT use the Service to stalk or otherwise harass another person or company or their representative.

You, as a user, agree to NOT use the Service to collect or store personal data about other users for business purposes or engage in commercial activities within Clark Community Network or on behalf of Clark Community Network without prior approval. This includes, but is not limited to, the following activities: displaying a banner that is designed to profit you or any other business or organization or provide cash or cash-equivalent prizes to users in exchange for hyperlinks to their web sites.

You, as a user, agree to NOT use the Service to promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals. This may include, but is not limited to, providing instructions on how to assemble bombs, grenades and other weapons or incendiary devices.

You, as a user, agree to NOT use the Service to use Clark Community Network as a forwarding service to another website.

You, as a user, agree to NOT use the Service to allow usage by others in such a way as to violate Clark Community Network’s Terms.

If any user is reported to be in violation with the letter or spirit of these (or any other) terms, Clark Community Network retains the right to terminate such account at any time without further warning.

16) DISCLAIMER OF WARRANTIES

YOU AGREE AND ACKNOWLEDGE THAT CLARK COMMUNITY NETWORK EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. CLARK COMMUNITY NETWORK MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED. YOU AGREE AND ACKNOWLEDGE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. CLARK COMMUNITY NETWORK IS IN NO WAY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER OR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL. YOU AGREE AND ACKNOWLEDGE THAT NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM CLARK COMMUNITY NETWORK OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS.

17) LIMITATION OF LIABILITY

YOU EXPRESSLY AGREE AND ACKNOWLEDGE THAT CLARK COMMUNITY NETWORK SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES EVEN IF CLARK COMMUNITY NETWORK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, RESULTING FROM: THE USE OR THE INABILITY TO USE THE SERVICE; THE COST OF PROCUREMENT OF A SUBSTITUTE SERVICE AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR ANY OTHER MATTER RELATING TO THE SERVICE.

18) GOVERNING LAW

You agree and acknowledge that the laws of the State of Arkansas shall govern the Terms and the relationship between you and Clark Community Network without regard to its conflict of law provisions. You agree and acknowledge to submit to the personal and exclusive jurisdiction of the courts located within Pulaski County, Arkansas. You agree and acknowledge that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms must be filed within one (1) year after such claim or cause of action arose.

19) GENERAL INFORMATION

The Terms constitutes the entire agreement between you and Clark Community Network and governs your use of the Service, superseding any prior agreements between you and Clark Community Network. The failure of Clark Community Network to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. If any provision of the Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms remain in full force and effect.

Why can't I post comments or blog entries?

There is a predetermined time restriction before you are allowed to post on the Clark Community Network (CCN). User's are required to wait to post to help deter malicious users from posting on the site.

After 1 hour, you can post comments.

After 24 hours, you can rate blog entries, rate comments, post blog entries, and create polls.

How do I tell where I am?

The Clark Community Network (CCN) software makes it very easy to locate where you are and places you can go.

If you look across the top Navigation bar, which is displayed in red, you will see breadcrumbs. Breadcrumbs are like file directories. As an example, you can see you are in CCN >>Technical Frequently Asked Questions by looking at the top right. The breadcrumbs change as you move about the site. You can always get back to the CNN entry page by clicking on CCN in the top bar.

If you look down the left Navigation panel, you will see several navigation blocks. Each block has a title and information. The blocks include:

A. User Information [your Username];

B. Best of Blogs for the top blogs;

C. Recent blog posts [for blog updates or posts];

D. Recent comments [for new comments added to a blog post];

E. Change Text [to increase or descrease the size of the displayed text];

F. Syndication [to syndicate the blog's content];

G. Search [a search feature across the Clark Community Network (CCN)];

H. Who's online [displaying who is currently online.

How do I track my friend's and buddies' posts?

One of the neat features in the new Clark Community Network (CCN) is the ability to track or locate what people are posting. This might be a friend, a buddy, someone on a buddy's list, or someone you just read and want to see what else they have posted.

Each CCN registered member of the community has a History page. You will be able to see their most recent posts on this page. In addition, you can click on the Track page and see where they are posting. To better understand the steps, click on the Flash Movie below to watch a brief demonstration.

You should close the viewing window after the movie ends.

How do I post a new entry to my Blog?

Adding a new comment to your my blog

1. Log in if your are not logged into the Clark Community Network (CCN),

2. Look under your Username in the top left navigation panel. Click on my blog.

3. If you have not created your my blog, do so now. If you have, click on add new comment.

4. Enter the Comment's Subject.

5. Enter the Comment in the Comment field. You can use HTML. Click the More information about formatting options link below Input Format for additional information.

6. Be sure to click the Preview comment button to check your text before clicking the Post comment button to add your comment.

How do I create my Blog?

How to Create my Blog

1. Create your account on the Clark Community Network (CCN)

2. Log in using your Username and password.

3. Look for my blog, under your Username in the left navigation panel in the top menu block, and click on it.

4. Your content screen will display a blank page with Post new blog entry at the top, click on Post new blog entry.

5. Enter a Title for the entry. This is a required field.

6. Select the Blog category from the range of choices.

7. Type in your entry comments in the Body field. This is a required field. Be sure to note the BBCode tags and other formatting options below the Body Field. You can preview and submit the blog.

8. Once your blog has been created, you can add comments.

How do I reply to a comment or post a new comment to a thread

Locate the Comment you want to Reply to

1. You will see a link directly beneath the comment labeled reply, click reply

2. A new screen will be displayed for you to Post new comment. Your Username will be displayed first.

3. Enter text for the Subject in the Subject field.

4. Enter your comment in the Comment field. This is a required field.

Be sure to use HTML to help make your comment more easily understood. You do not need to be an HTML whiz. The software we are using has easy to use formatting options to help you. Check More information about formatting options below Formatting Guidelines for help in presenting your views using HTML.

How do I add someone to my buddy list

How to add a Buddy

Locate the person you want to add to your buddy list. It might be someone whose Blog has been promoted to Best of the Blogs. Or, it might be someone you see in the Who's online block. Be sure the name is in blue and when you place your cursor over the name their name changes to a link.

1. Click on the individual's name (link).

2. You will see your History page.

3. Look under Buddy Actions and you will see Add [the person's name] to my buddy list.

4. Click the Add [the person's name] to my Buddy list and the confirmation screen is displayed. The Clark Community Network (CCN) will notify the user you have added her or him to your buddy list.

You can also Cancel adding the person to your Buddy list.

How do I add an image in my blog entry or comment

Displaying images

The [img] tag allows you to display an image in your post. You need to specify a URL to the image, so it needs to be accessible somewhere on the internet. Beware of adding very large images to your text, or otherwise the page will load very slowly! Remember, some of our Community Members use dial-up modems so please use images to add value to your entry.

If you enclose a URL in an [img] tag, then it will be replaced with code to display the image. For example A good screenshot: [img]http://example.com/screenshot.png[/img] will show you the screenshot (if it exists).

You can also specify the desired display dimensions of the image by adding a dimension parameter to the [img] tag. A good screenshot: [img=640x480]http://example.com/screenshot.png[/img] will display the image in 640x480 (though the full image will be downloaded). Do not use this to show a thumbnail of an image!

You are free to link an image to an external destination by enclosing the [img] tag with an [url] tag: See [url=http://example.com][img]http://example.com/screenshot.png[/img][/url].

How do I add a picture to my account?

You can add an image that will be posted on your my blog.

1. Look in the top left navigation panel under your Username. Click my account.

2. Your History screen will be displayed. Notice the edit tab above History. Click edit.

3. Your Account information screen is displayed. Use the slider bar to scroll down to the Picture section.

4. Your image or picture can be no larger than 30kb. The dimensions are 100X100 pixels. Click the Choose File button to locate the image or picture file on your hard drive. The file is added and you will see the file name displayed to the right of the Choose File button.

5. Click Submit and there will be some delay as the file is uploaded and placed in the correct location. Once the upload is complete, you will be returned to the History screen and your picture will be displayed on the far right.

6. You can Delete the picture by returning to the edit screen and clicking the Delete picture button, and then clicking Submit.

How do I create a block quote?

You can create text in a block quote by using HTML tag.

Display either a new comment or entry.

Be sure Full HTML is selected below Input Format.

You then type your text between the blockquote beginning and ending HTML tags, as in the example below.

We used [code name] to show you what the code looks like. You would replace the [ with a < and the ] with a > to code this correctly.

How do I add a signature?

How do I add a Signature to my account?

You can add a Signature that will be posted after each of your comments.

1. Look in the top left navigation panel under your Username. Click my account.

2. Your History screen will be displayed. Notice the edit tab above History. Click edit.

3. Your Account information screen is displayed. Use the slider bar to scroll down to the Signature section.

4. Your Signature can contain HTML code. Remember, your signature will be added to each entry or comment you make. Please be considerate to others and keep these short so members of the Clark Community Network (CCN) do not need to read 4-5 lines every time you post.

5. Click Submit and your signature will be added.

6. You can Delete the Signature by deleting all of the text in the signature field and clicking Submit.

I've been a member of CCN since the beginning. Why doesn't my old password and login work?

Recently, we had to make a software change from Scoop to Drupal. We did not transfer old logins and password. If you have not signed up since we made the transfer to Drupal, then simply register as a new user.

Why won't my password work?

The password you receive in the registration email will work. It is CaSe SENsiTive.

Make sure you type it exactly as you see it in the email, or highlight, copy and paste it into the password field. Once you have logged in, you can change your password to something more user friendly by clicking "my acccount" and then clicking the edit tab in the center area.
