From the Diaries. Oregon's assisted suicide law is the first major issue to come before the Roberts Court. -- Brent

Oregon's legislators who voted to confirm Roberts have their day in court- What will happen to Oregon's Assisted Suicide Law?

Senator Ron Wyden (D) who voted to confirm Judge Roberts should be sweating!

From The Oregonian http://tinyurl.com/cqyrc

Newly installed Chief Justice John Roberts on Wednesday sharply questioned a lawyer arguing for preservation of Oregon's physician-assisted suicide law, noting the federal government's tough regulation of addictive drugs.

"The Justice Department's attempt to go after law-abiding Oregon doctors hasn't held up in the lower courts, and their arguments were equally without merit today," U.S. Sen. Ron Wyden said in a statement sent out by the office of the five Democrats.

"Even a conservative reading of the law should lead to one conclusion: that Oregonians have a right to determine medical practice within our states own borders," Wyden said.

This is it folks, it will be interesting to see where this goes, the democrats who voted to confirm Roberts will be watching this closely.

I don't have a very good feeling about it... I don't trust him to put his religious beliefs aside. We'll see I guess.

Rehnquist 2.0. He will vote for the Bush government's position. He doesn't care about what voters in Oregon want. His argument about doctors having the right to give body builders steroids was silly. The point is body builders who compete are barred from taking them. It's not about the doctors. O'Connor brought up that doctors can give the drugs to execute criminals and that's legal under state laws. I'm really going to miss that lady. She is so much smarter than the new smart guy. And legions ahead of the lady who thinks Bush is the most intelligent man she's ever met.

After reading more about the oral arguments and questions Roberts asked strongly favoring the Ashcroft position, it appears Roberts is to the right of his predecssor and even Clarence Thomas, both of whom voted to stay out of the states right to decide about the use of medical marijuana. Roberts appears to be in favor of absolute federal control. Meanwhile today Broder implies Miers is another Bork.

That's a great analogy, that doctors can give lethal dosages to criminals but not someone who is dying and suffering. Next thing you know we won't be able to put horses down or cats! ;o)

The United States goes not abroad in search of monsters to destroy. She is a well-wisher to the freedom and independence of all...if she might become the dictatress of the world. She would be no longer the ruler of her own soul.-John Quincy Adams
